Terms of Use
1. Acceptance of Terms
By installing or using Monitor Control (Free) or Monitor Control (Pro) (the “Software”), you agree to these Terms of Use (“Terms”). If you do not agree, do not install or use the Software. You represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and are able to enter into a binding contract.
2. License Grant
Sonic Control LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Monitor Control for its intended purpose: controlling compatible monitor controllers via Elgato Stream Deck.
- Monitor Control (Free): Licensed at no cost for personal and commercial use.
- Monitor Control (Pro): Licensed upon purchase through the Elgato Marketplace for personal and commercial use by the purchaser.
3. Purchases and Refunds
Monitor Control (Pro) is sold and distributed through the Elgato Marketplace. All purchases, billing, and refunds are processed by Elgato and are subject to the Elgato Marketplace terms and refund policy in effect at the time of purchase. Sonic Control LLC does not process payments and does not independently issue refunds for Marketplace purchases. Please direct refund requests to Elgato in accordance with their policy.
4. Restrictions
You may not:
- Reverse engineer, decompile, or disassemble the Software, except as permitted by applicable law;
- Redistribute, sublicense, rent, lease, or lend the Software;
- Remove or alter any proprietary notices, labels, or marks;
- Use the Software for any unlawful purpose.
5. Compatibility
Monitor Control is designed to work with compatible monitor controllers via local network WebSocket communication. Sonic Control LLC does not guarantee compatibility with all hardware configurations, firmware versions, or network environments. Functionality may vary based on your specific hardware setup and firmware version.
6. Assumption of Risk and Safety
You acknowledge that Monitor Control sends commands to professional audio monitoring equipment and that improper use, configuration errors, network conditions, or unexpected behavior could result in sudden or unintended volume changes. You accept full responsibility for monitoring playback levels and for protecting your hearing and your equipment, including the use of appropriate safeguards such as conservative starting levels and hearing protection. Sonic Control LLC is not responsible for how you configure or operate your monitoring system.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MONITOR CONTROL IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SONIC CONTROL LLC DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SONIC CONTROL LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF MONITOR CONTROL, INCLUDING BUT NOT LIMITED TO DAMAGE TO AUDIO EQUIPMENT, HEARING DAMAGE, OR LOSS OF DATA.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF SONIC CONTROL LLC ARISING OUT OF OR RELATED TO THE SOFTWARE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SOFTWARE, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct, or for death or personal injury caused by negligence to the extent such limitation is not permitted by law. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Third-Party Hardware Warranty
You are solely responsible for verifying that your use of Monitor Control complies with the terms of any warranty, service agreement, or support contract associated with your audio hardware. Sonic Control LLC makes no representations regarding the effect of this Software on any third-party hardware warranty.
10. Intellectual Property
Monitor Control is the intellectual property of Sonic Control LLC. All rights not expressly granted herein are reserved.
11. Third-Party Trademarks
Monitor Control is developed by Sonic Control LLC and is not affiliated with, endorsed by, or sponsored by Trinnov Audio or Elgato/Corsair. “Trinnov” and “Nova” are trademarks of Trinnov Audio. “Elgato,” “Stream Deck,” and “Corsair” are trademarks of Corsair Gaming, Inc. and/or its affiliates. All third-party trademarks are the property of their respective owners and are used solely for identification and compatibility purposes.
12. Updates
Sonic Control LLC may release updates to Monitor Control at its discretion. Updates may add, modify, or remove features. Continued use after an update constitutes acceptance of any changes.
13. Termination
This license is effective until terminated. It terminates automatically if you fail to comply with these Terms. Upon termination, you must uninstall and destroy all copies of the Software. Sections that by their nature should survive termination (including Sections 7 through 11, 14, and 15) will survive.
14. Governing Law and Venue
These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Software shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the personal jurisdiction of those courts. This Section does not deprive you of any protection of mandatory consumer-protection laws of your country of residence.
15. Consumer Rights
If you are a consumer, you may have statutory rights under the laws of your country or state that cannot be waived or limited by contract. Nothing in these Terms affects those non-waivable statutory rights, and these Terms apply only to the extent permitted by applicable law.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with any terms presented at the point of purchase through the Elgato Marketplace, constitute the entire agreement between you and Sonic Control LLC regarding the Software and supersede all prior or contemporaneous understandings, representations, or agreements.
18. Assignment
You may not assign or transfer these Terms or your license without the prior written consent of Sonic Control LLC. Sonic Control LLC may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
